Accuracy of Content

The Cushion Parlour has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All cushion prices are displayed inclusive of VAT. Cushion Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only.

 

 

Reproduced Colours

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's Display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, The Cushion Parlour disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. The Cushion Parlour shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website. A sample of the fabric used in the production of your item can be supplied by The Cushion Parlour prior to finalising your order. Please see below for more information labeled Fabric Samples.

 

 

Reproduced Print

Prints can be effected by the type of materials used in the manufacturing of the goods. So for example silks will often not have the same print definition as other cloths. The Cushion Parlour cannot refund or cancel goods where the printing is effected in this way. A sample of the fabric used in the production of your item can be supplied by The Cushion Parlour prior to finalising your order. Please see below for more information labeled Fabric Samples.

 

 

Fabric Samples

If you wish to be certain of the colour or print we can supply a sample in advance of your order. A charge is usually made for this service and is not covered by the Distance Selling Regulations. Should you wish to receive a sample please email: customerservices@cushionparlour.com with your email address, name and contact telephone number and item details you require the fabric sample for . We will then contact you to make arrangements for payment and delivery of the sample fabric used in the manufacture of the selected item.

Cushion back material

The material use on the backing used in the manufacturing of the cushion where it is not the same as the cushion front will be 100% man made polyester.

Damage to your computer

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. The Cushion Parlour shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Password/account security

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. The Cushion Parlour shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

Privacy Promise

Your privacy is if the highest importance to us, and we promise never to release your personal details to any outside company. When you make a purchase from our website, we collect certain personal information from you(for example:your name, email address, payment address and details).

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

Ordering errors

You are able to correct errors on your order up to the point at which you click on ‘submit’ on the final page of our ordering process. After this the order cannot be changed or amended as the fabric used in producing the cushion is cut to size for each individual cushion ordered. All cushions are made to order for each transaction.

Acknowledgment and acceptance of your order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details. Our acceptance of your order will take place upon dispatch of the product(s) ordered.

Cancellation right

Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods (with the exception of made to order items). Please ensure you check when placing an order on this website to see if the item is made to order and therefore cannot be sent back or returned under the Distance Selling Regulations. If goods are covered by the Distance Selling Regulations please notify Cushion Parlour within seven days of receipt of the goods either by telephone: 01943 865 100, or email: customerservices@cushionparlour.com, or post.

 

Where goods are being returned under the Distance Selling Regulations the customer is responsible for paying the cost of return postage. Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered.

DELIVERY & RETURNS INFORMATION

We aim to process all orders within 72 hours (subject to availability).

If any items on an order are not available we will to contact you with a delivery date. If this date is not acceptable, you have the option to cancel your order at this time.

Delivery is usually 10-15 workings days from date of order.

All orders will be delivered between 7.30 am-6-00pm Monday to Friday.

If your order cannot be fulfilled for any reason, we will endeavour to contact you as soon as possible.

Delivery for all orders to the U.K. Mainland is £6.50. There is an additional charge for the Highlands, Ireland and Northern Ireland. We do not deliver to the Channel Islands and Overseas.

Deliveries to the Channel Islands and overseas can be arranged subject to a written quote for carriage.

You must notify us within 5 working days of delivery if any goods are damaged or missing. Returned damage goods or missing goods outside this period will not be accepted.

What happens if I'm out when you deliver?

Most deliveries need to be signed for, the driver may be able to leave with a neighbour, or your parcel will be returned to the nearest depot. They will leave a card explaining where your parcel is and the procedure for collection. Cushion Parlour are in no way responsible for goods not being delivered if and address is given incorrectly, or a delivery is attempted to be made but is not signed for or the procedure for collection is not followed.

Exclusions of liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers The Cushion Parlour and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Changes to legal notices

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.

Law, jurisdiction and language

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

These terms and conditions do not affect your legal rights.
